Man Found Guilty In Case Of Tossing Infant

Prosecutors Ask For Extended Sentence

POSTED: 3:47 pm HST June 26, 2009

A Circuit Court jury on Friday found a 31-year-old man guilty of attempted manslaughter for tossing his infant daughter in his van.

Pulumataala Eli faced attempted murder charges, but the jury found him guilty of the lesser charge.

Sarah Fuller, 16, told the court that Eli took her decision to break up with him out on their 7-month-old daughter. Prosecutors said Eli threw the child three times against the van's back seat.

Eli admitted beating the baby, but did not want to kill her.

The prosecutor said the child is now a little over 2 years old, in foster care and in therapy for brain damage, walking and talking like a child half her age.

Eli will appear before the court again on Nov. 2. The judge will hold a hearing for an extended sentence.

The defendant was on probation at the time of the attack for assault and a firearms violation. The attack on a child under 8 years old can also warrant an enhanced sentence.

Eli faced up to 20 years in prison on attempted manslaughter charges. Under enhanced sentencing, he could be given life in prison with the chance of parole.
