Attorney: Marijuana minister to change pleaUPDATED 9:37 PM HST Sep 25, 2013Video Transcript
Island marijuana minister Roger Christie could be getting out fairly soon. Christie is set to plead guilty this Friday. KITV-4's Nana OhKawa joins us now with more from Christie's attorney. Nana? Roger Christie's attorney told me the marijuana advocate is not giving up his fight. But, he's now aiming for a battle in higher court. Roger Christie founded the Hawaii Cannabis Ministry, and it's true to its name. Treating marijuana as sacrament. The law still treats marijuana as contraband, so the ministry is shut down, Christie is in the federal detention center, and both he and his wife are set to plead guilty to distributing marijuana. Something Christie's attorney says he's never denied. 301 IF SOMEONE IS CONDUCTING A RELIGIOUS ACTIVITY AND IT'S A LEGITIMATE RELIGION AND THEY ARE SINCERE UPON THEIR BELIEF THE GOVENRMENET CANNOT INFRINGE UPON THAT ACTIVITY UNLESS THE GOVERMENT HAS A COMPELLING INTEREST TO DO SO 313 Christie had 284 marijuana plants.. And his attorney says the ministry sold pot to members three times a week, selling about a half pound each time. Their claim: distributing marijuana through their ministry was protected. The district court judge recently ruled that the Christie's could not use the Religious Freedom Restoration Act as their defense. 18 THE PLEA AGREEMENT THAT THE PARTIES ARE FINALIZING WOULD ALLOW REVEREND CHRISTIE AND HIS WIFE TO APPEAL THAT RULING TO THE 9TH CIRCUIT COURT OF APPEALS AND THE UNITED STATES SUPREME COURT IF NECESSARY AND WE COMPLETELY INTEND ON DOING THAT 30 Roger Christie has been held without bail since July 2010. His attorney has tried 8 times to get him released. After more than 3 years sitting in prison, with the plea agreement he could get released as soon as 6 to 7 months from now. 321 REVEREND CHRISTIE IS AS ENERGIZED AND POSITIVE AND UPBEAT AS EVER HE LOOKS FORWARD TO TAKING HIS FIGHT AND CAUSE TO THE APPEALS COURT WHERE HE REALLY BELIEVES SOME GOOD RESULTS WILL COME334 Christie's trial had been set for next month, Yunji!
