Adam Gutowski says he was "severely beaten"

Christopher Deedy's friend says Kollin Elderts started fight

HONOLULU -

"He was nothing close to me, very controlled, nothing close to my state," said Adam Gutowski.

He said the night of a deadly shooting at McDonald's, he may have been drunk, but he said despite a night of bar-hopping, his friend Christopher Deedy was not.

"Was there anything that suggested he was under the influence of alcohol?" asked defense attorney Brook Hart.

"No. Not that I could tell," said Gutowski.

Without a blood-alcohol test to go by, it's what prosecutors have been trying to prove since the start of the trial.

"Did you ever tell your friend Chris to walk away?" asked deputy prosecutor Janice Futa.

"I did not," said Gutowski.

Gutowski said he missed the moment when Deedy approached 23-year-old Kollin Elderts, but tried to step between the two when the heat started to rise.

"I'm trying to block him from getting to Chris. He was getting pretty aggressive toward Chris," he said of Elderts.

It was then that Gutowski said Elderts punched him -- with Eldert's friend Shane Medeiros close behind.

"What was Shane doing?" asked Hart.

"He was attacking me," said Gutowski.

He said Medeiros was still beating him when Elderts got up and faced Deedy.

But he said the next chain of events, happened out of his sight and those events were unclear in his mind.

"What were you feeling at the time?" asked Hart.

"Afraid, fear and pain," Gutowski said.

At the hospital Gutowski said he saw his friend for the last time, knowing his ordeal was no longer the worst thing that happened that night.

"I was trying to express I was going to be OK in the long run," he said he told Deedy.

Prosecutors have maintained it was Gutowski who made the first move toward Elderts.

They also poked holes in his testimony that Elderts may have said he had a gun too.

Gutowski admits he got some details wrong in his interview with police, in part because of the alcohol, but also because he says he was tired and beat up.
