A man accused of sexually assaulting a Mililani restaurant owner was declared unfit for trial in Honolulu Circuit Court Monday.

Joseph Navas, 46, of beating and sexually assaulting the owner of Sun's Korean BBQ at the Mililani Shopping Center in May 2010 while she was closing the restaurant.

Prior to the incident, Navas had been released from the Hawaii State Hospital because doctors determined he was not an imminent danger to himself or others.

This was the third time Navas was found unfit for trial.  He is current at the Hawaii State Hospital.
