Prosecutors say a warrant of arrest has been issued for Ralph Riveira, the man who was shot by a Honolulu police officer in Kalihi Valley, on a charge of attempted assault in the first degree.

Riveira will be served the warrant at a later date.  He was hospitalized in critical condition after the shooting.

Police responded to a residence on Machado Street Friday for a domestic dispute.

Riveira was found in the front yard arguing with family members.  He approached the police vehicle with a foot-long metal stake in his hand and threatened an officer, according to police.

When Riveira raised the stake over his head and was within a few feet of the officer, the officer fired his weapon multiple times.

Riveira's mother was also arrested for terroristic threatening, but charges were declined after determining her actions did not rise to the level of a true threat, according to prosecutors.
