Good evening, I'm Paula Akana. The start of week-2 in the murder trial of a federal agent... centers around what one officer heard, saw -- AND DID -- as 23-year-old Kollin Elderts lay dying at a Waikiki McDonalds. KITV4's Lara Yamada has our continuing coverage live from the newsroom. Lara? We've seen parts of the video - but for the first time -- we are now HEARING -- what happened too. A witness' cell phone video starts... as Officer Sterling Naki reaches Special Agent Christopher Deedy -- as he sat hovered over Elderts -- already covered in blood. But what happened in the minutes that followed is ALSO now being called into question. 1558 NATS: cell video: sirens, chaos Moments after the shot that killed Kollin Elderts, a witness started recording. With sirens blaring, people crying... Officer Sterling Naki testifies, it was so chaotic, he didn't initially think to ask the man hovered over Elderts -- who he was or why he was there. 2928 It appeared the defendant knew what he was doing. 3336 Did you ask agent Deedy are you an officer? No. 2644-52 Did you asked everybody where gunman went? Everybody but defendant? Yes. NATS: cell video: crying? Naki says, with dispatch saying the suspect may have run out the door... ...and Elderts gravely wounded, he focused on that. And noticed this about Deedy: 1113 When he spoke to me I could smell his breath. Naki says he smelled alcohol, then noticed other tell-tale signs. 1002 His eyes had a dazed glassy eyed look, his speech was slightly slurred but bad, not not stumbling words. Emergency crews and more cops arriving.... ...witnesses still roaming around -- one even picking up evidence -- Elderts' cell phone -- on a counter nearby... ...Naki says he remembers Deedy's actions, but not his words. Until he says Deedy said this: 311 He said he had a gun. I said a gun? He said yes. I have a gun. I shot him. Naki says Deedy walked to officers, said he had a gun, said his head and jaw were hurting, then surrendered completely. Court heated up late this afternoon with the testimony of Taylor Auyoung. Taylor says she was the only one in her group of friends at McDonalds that night -- who completely sober. She testified she heard Elderts yelling quote: "If you're going to shoot me then F-ing shoot me."
