Two hikers say they were mistaken for burglars,,, beaten, then forgotten. One's a local musician and now he has filed a lawsuit saying... what a team of officers did... deserves punishment. KITV4's Lara Yamada talked to him about that bizarre encounter. :01 ;43 JOHN 518-26 Next thing you know, I had my head smashed into the ground so hard that I remember the impact vividly. A year and a half later, John Helm says not a day's gone by, when he hasn't thought about what happened the afternoon he and his friend Jonah went hiking up Wilhelmina Rise. JOHN 554-59 Looking at these pictures it just brings back the anger and the frustration. He says they saw the police chopper flying over head -- then -- the SWAT team officers on the ground and in their face. JOHN 500-09 I saw a New York Yankees cap come over ridge, then another guy, and another guy, and a semiautomatic, pointed it at me, and they said get the F down! MYLES 1453-59 No only did they brutally beat him up and falsely arrest him, but then, they propagated a series of lies. Helm's attorney Myles Breiner just filed a lawsuit, saying officers mistook the two for supected burglars, then later claimed they fell and injured THEMSELVES. He says -- some of those officers -- already with records for using excessive force. MYLES 1207-17 No one's been diciplined, no one's been removed from duty -- just the opposite. They're still out there with carte blanche to arrest people and do exactly what they've done today. JOHN 757-01 I've just had to bury this thing every single night while I play. The irony: Helm, a musician, says he plays to show others the beauty of the islands. A performance dampened by an experience he can't forget. JOHN 209-13 We need police officers. They have a hard job. But this was wrong. Lara Yamada KITV4 News. We spoke with representatives for the Honolulu Police Department and the Police Commission -- with the same response: no comment on the case. H-P-D says NO suspected burglars have ever been arrested in connection with this case.
