Hearing over Deedy trail transcriptsUPDATED 7:32 PM HST Feb 10, 2014Video Transcript
A testy legal battle tonight over courtroom discussions during the murder trial for federal agent Christopher Deedy. Before jurors declared themselves hopelessly deadlocked .. There was a flurry of discussions in the courtroom. The courtroom was always CLEARED, and those transcripts were sealed. KITV4's Paul Drewes shows us... now the debate is over what should be made public .. THE CHRISTOPHER DEEDY TRIAL WAS A HIGH STAKES CASE -- EITHER A CONVICTION FOR MURDER OR AQUITTAL IN THE DEATH OF KOLLIN ELDERTS. Nothing in between. WITH A RE-TRIAL COMING UP - JUDGE KAREN AHN DOESN'T WANT TO DO ANYTHING TO PREJUDICE A NEW JURY. judge@1:46 "The court is doing its best to make sure the defendant gets a fair trial and the state gets a fair trial" BUT THE DEFENDANT'S ATTORNEY SAYS DEEDY DOESN'T MIND IF THE PUBLIC LEARNS WHAT WAS DISCUSSED IN THE COURTROOM ON AUGUST 26TH. Thomas@2:35 "we stand by our filing where we stated we have no opposition to the media's request" THERE HAS BEEN SPECULATION ABOUT THE HUSH-HUSH MEETINGS, AND NOW A HINT FROM THE DEPUTY PROSECUTOR. cheryl 6:58-7:08 "in the event the court decides to release the transcripts, it redacts the names of the jurors involved in any closed conference" THE TRIAL INVOLVED EXHAUSTIVE ANALYSIS OF EVERY SECOND OF SURVEILLANCE FOOTAGE AND FOCUSED ATTENTION ON EVERY TINY DETAIL OF THAT FATEFUL NIGHT. SO THE MEDIA'S ATTORNEY WONDERS WHY THE DISCUSSIONS -- JUST BEFORE THE JURY'S MISTRIAL VERDICT ARE STILL A MYSTERY. portnoy@9:46-9:58 time has passed, the case is over, the jury been dismissed. There is no legitimate reason to seal any part of those transcripts anymore based on the case law of the 9th circuit and the supreme court and virtually every court PORTNOY COULDN'T ARGUE ANY FURTHER, BECAUSE EVEN HE DOESN'T KNOW WHAT IS IN THE TRANSCRIPTS! judge@8:10-8:20 "if I tell you these are some of the matters contained in the transcript - so that you can make your objection, we're telling you what's in the transcript. that's why I have a hard time dealing with this whole matter" AHN'S FRUSTRATION WITH THE PROCEEDINGS WAS EVIDENT BY THE END OF THE HEARING, AS PROSECUTING AND DEFENSE ATTORNEYS REQUESTED THE ACTUAL RE-TRIAL TO ONLY RUN 4 OUT-OF 5 DAYS A WEEK. 16:08 i'm thinking of going 5 out of 5 and finish this case AT CIRCUIT COURT, PAUL DREWES KITV 4 NEWS. Judge Ahn has another three weeks to decide IF she'll release the transcripts. KITV4 is one of the media organizations arguing the transcripts should be made public.
