HIGH GEAR ... with FIVE witnesses taking the stand today. KITV4's Lara Yamada joins us with the wide-ranging testimony... from experts, to medical staff, to witnesses. Lara. The defense team for special agent Christopher Deedy wasted no time... diving right back into the testimony of the sole security guard at McDonalds that morning ... who says the minute Kollin Elderts walked in the door... she noticed. TAPE 1 @ 2818 Mr Elderts, it was something unusual. He was louder than other customers. McDonald's security guard Rosalinda Soriano says what Kollin Elderts' friend Shane Medeiros characterized as "joking," to her, came off as aggressive harrassment. TAPE 1 @ 4402 Continuously. Not joking. Bullying. Irritating Mr. Perrine. A stark contrast -- to how she says special agent Christopher Deedy was acting. TAPE 1 @ 3030 Mr Deedy was talking to Mr Edlerts like a concerned guy that wants to control Mr. Elderts behavior. She watched what she called the "rumble" unfold, as Deedy banged his head on the hand sanitizer, then after shots were fired -- Deedy performing CPR on Elderts -- but was unclear who got physical first. TAPE 2 @ 10940 You did not see who started it? Did not see who threw the first punch? Correct. Retired Honolulu PD trainer Fabian Loo testified he trains officers to carry weapons 24/7, to use minimum force -- and reasonably -- but that it's ultimately up to the officer to decide to react -- adding officers CAN use deadly force, even if SOMEONE ELSE's life -- is in immediate danger. TAPE 2 @ It's going to be their own individual skills, what they deem as reasonable at the incident, because nobody else was there, if they have backup and what behavior is in front of them. That's the key. Then there was Joey Keane -- seen several times in the pink shirt. Admittedly drunk -- he says he was surprised when police refused his statement, or entry back in -- to wash the blood off his hands. But he says it was the shooting itself that angered him the most. TAPE 3 @ 2:42:23-26 I guess didn't see why someone had to die I guess. At the Queens Medical Center nurse Margaret Nakamura testified a groggy Adam Gutowski admitted he'd been drinking... while she says a seemingy sober Deedy... told her he was not. TAPE 3 @ 2:48:10 He walked in with a steady gate, not off balance at all. 4838 What was his overall demeanor? Quiet and cooperative. Testimony continues tomorrow... and we are getting word that Christopher Deedy himself... IS expected to take the stand. Back to you.
