The Australian tourist who pleaded no contest to third-degree negligent homicide in a Hawaii personal watercraft crash that killed a California teen was sentenced to the time he already served  in jail and will pay restitution.

Restitution was set at a little more than $78,000.  The judge also said Tyson Dagley would set up an arrangement for probation in Australia.

Dagley entered the plea to the misdemeanor charge last month.

Investigators say the 20-year-old man was standing on his rented watercraft before it hit 16-year-old Kristen Fonseca's watercraft from behind Aug. 5.  They say he was looking at his girlfriend, who was taking video and photos, and he wasn't paying attention to where he was going.

The Vacaville, Calif. teen died the next day.

Mario Canton, Fonseca's father, told the court Wednesday, "Our family's life is turned upside-down.  We are unable to function at home.  We go to sleep crying, wake up crying."

Fonseca's mother, Evangelina, read a poem to the court that Kristen wrote when she was 8 years old.  The poem said how Fonseca wondered if she will ever have children and how she wanted to be a doctor when she grows up.  Evangelina's hands were trembling she read the poem.  Dagley sobbed as he heard Fonseca's words.
