Agent accused of murdering man claims immunity

 UPDATED 10:38 AM HST May 18, 2012

The special agent accused of the fatal shooting of a Kailua man in a Waikiki fast food restaurant last November is claiming immunity from prosecution.

Christopher Deedy claims he was working as a federal law enforcement officer for the Asia-Pacific Economic Cooperation conference when he shot and killed Kollin Elderts.

Deedy's attorney filed legal papers seeking to dismiss the case or, at least, delay the trial because of the enormous publicity about the shooting and the difficulty of getting federal officials to testify.

A request was also filed to dismiss the indictment against Deedy because of a defective grand jury proceeding.

A Circuit Court judge is scheduled to hear the arguments on the motion in July.
