Deedy trial focuses on evidence specialistUPDATED 9:09 PM HST Jul 22, 2014Video Transcript
Special Agent Christopher Deedy focused on a report filed by an HPD evidence specialist, and whether Deedy flashed Kollin Elderts his badge before the shooting began. KITV4's Andrew Pereira is back from Circuit Court and has the very latest... Andrew? Yunji, former Honolulu Police Detective Theodore Coons says -- he interviewed more than 30 people -- after Agent Christopher Deedy shot and killed 23-year old Kollin Elderts at a Waikiki McDonalds in November 2011. However he never ordered one specific report that Deedy's defense pounced on. 29 133 Detective Theodore Coons, now retired, says he ordered DNA and blood samples taken from Deedy, Kollin Elderts, his friend Shane Medeiros and Deedy's friend Adam Gutowski. Coons also says he ordered one of his evidence specialists to file an EXTRA report. In circuit court Tuesday, Coons testified technicians TYPICALLY only report what's based on evidence -- NOT PERSONAL OPINION. But he ordered HPD evidence specialist Toy Stech to file an extra report anyway, that stated alcohol was noticeable on Deedy's breath. DET. THEODORE COONS/RETIRED HPD: "I TOLD HER TO MAKE NOTES ABOUT WHAT SHE OBSERVED, AND TOLD COMMAND THERE WERE OBSERVAIONS TO OBSERVE THAT NEEDED TO BE DOCUMENTED." There was also testimony on why Coons failed to request blood splatter and bullet trajectory reports. Coons said two points of entry are needed to measure a stray bullet's trajectory, and none existed inside the McDonalds where the shooting took place. However Coons admitted there was a mark on a steel beam behind dry wall where one of the bullets ended up. Even so, he felt no need to order a trajectory report that may have shown Deedy fired while laid out on the floor. DET. THEODORE COONS/RETIRED HPD: "IN THIS SITUATION WE HAD ONE SHOOTER, WE HAD ONE GUN AND IT WAS CAPTURED ON VIDEO. THAT WAS NOT NECESSARY." The most compelling testimony on Tuesday came when Coons said that in his official 64-page closing report, it appears Deedy flashed Elderts his official State Department badge moments before three shots were fired. DET. THEODORE COONS/RETIRED HPD: "ISN'T IT TRUE AT 2:40:54 YOU INDICATED IN YOUR CLOSING REPORT THAT DEEDY APPEARS TO BADGE ELDERTS? THAT'S WHAT DET. BOYLE WROTE IN THE REPORT, YES. DET. BOYLE WROTE AND YOU SIGNED IT? YES. IN FACT SAYS YOUR NAME, RIGHT? YES, WE BOTH SIGNED THE REPORT." The prosecution could be close to wrapping up its case against Deedy. Trial is scheduled to resume tomorrow. Paula and Yunji?
