An accused murderer ON THE STAND, describing the longest SECOND of his life. Good evening, I'm Kenny Choi. And I'm Ashley Moser. Paula and Yunji have the night off. In this case.. It's a federal agent on trial for murder... Christopher Deedy shot and killed Kollin Elderts inside a Waikiki McDonald's... He claims self defense. This is actually a murder re-trial after the first jury was deadlocked. KITV4's Brenton Awa was in the courtroom for today's crucial testimony.. Christopher Deedy was on the stand from the start today. He picked up his story right where he finished off yesterday -- at the moment he reached for his gun during the argument with Kollin Elderts. 15-24 JASON TAPE 2 -- 9:38:28 "I WAS THINKING I WAS GOING TO DIE." Christopher Deedy says saving his own life meant taking somebody else's. That somebody was Kollin Elderts... And today Deedy took us through the deadly encounter inside a Waikiki McDonalds.. 9:31:17 "AT THIS POINT IN MY MIND, I'M REALLY SCARED. THIS IS THE MOMENT I'M DRAWING MY GUN AND IT'S SOMETHING YOU NEVER WANT TO HAVE TO DO." Deedy says it was as if time stopped. 9:32:09 "IT FELT LIKE THE LONGEST SECOND OF MY LIFE. HOLDING THE GUN WAS NO DIFFERENT BECAUSE AT THAT MOMENT I DON'T WANT TO PULL THE TRIGGER AND YOU WANT THIS PERSON TO STOP SO YOU DON'T HAVE TO, BUT INSTEAD HE REACHED FOR MY GUN AND STARTED REACHING TOWARDS ME," SAID DEEDY. According to Deedy.. agents are trained to shoot to kill in those situations. 9:34:14 "AS HE MOVED FORWARD I PULLED THE TRIGGER AND IT WENT STRAIGHT UP PAST HIS FACE." The first shot -- missed. That's when Deedy says Elderts drove him onto his back. Deedy says he was lying on the floor with Elderts straddling him in a fight over his gun. 9:39:07 "ASIDE FROM ALL THE PRE- ASSAULT INDICATORS, STATING HIS INTENT OR WHAT IT MAY HAVE BEEN, NOW HE'D COME AT ME AFTER IDENTIFYING MYSELF AS A LAW ENFORCEMENT OFFICER, HE KNEW I HAD A GUN, I DREW MY GUN, HE WAS REACHING FOR MY GUN. IS THAT WHY YOU .... ...YES." Deedy says Elderts was punching him and the thought of dying crossed his mind. The next seconds went by in a flash. 9:39:48 "I WAS PULLING MY ARM AWAY FROM HIM AND HIS HAND CAME OFF OF MY GUN AND I WAS ABLE TO BRING IT BACK A LITTLE BIT MORE. TOOK OFF TWO MORE SHOTS AS HE BROUGHT HIS HAND DOWN, AND WHEN I TOOK THOSE TWO MORE SHOTS, HE CAME BACK DOWN ON TOP OF ME." Prosecutors got their chance to question Deedy today. They pointed out that he was the first person to get physical that night by landing a thrust kick on Elderts. They also questioned why the federal agent didn't just walk away from the situation or why he didn't call for back-up. They claim Deedy was drunk. Deedy finished his time on the witness stand today.
