An Army officer investigating Hawaii born Lt. Ehren Watada recommended that his case be tried by general court martial, according to an army spokesman at Fort Lewis, Wash., where Watada is stationed.

He is charged with contempt, conduct unbecoming an officer and other offenses for refusing to deploy to Iraq.

Watada said he disobeyed the orders because he believes the war is illegal.

The investigating officer's final report was expected Friday.

Watada's commanding officers will have the final say on what action will be taken against him.

If tried, he could face up to seven years in prison.
