Court Refuses To Hurry Appeals Process For Kamehameha Applicant

POSTED: 4:53 pm HST August 11, 2005

The anonymous non-Hawaiian student who wants to go to Kamehameha Schools had another disappointment Thursday.

Despite winning at the 9th Circuit Court of Appeals, it now looks like John Doe has no way of getting admitted for several weeks or months.

A three-judge panel for the court declared Kamehameha's Hawaiians-first admissions policy illegal earlier this month. The panel ruled 2-to-1 that the school's admission policy was illegal since it purposely discriminated on the basis of race.

The school is asking for another hearing before a larger panel of judges.

The appeals court refused to speed up that process so the student could have a chance to enter the school this year. He is a senior in high school.

It could be several weeks or months until the 9th Circuit Court of Appeals makes its next decision.
