Officials said the shooting happened at about 8:15 p.m. on the beach between Waiohuli Beach and Lipoa Street in Kihei. Police say the man, Charles Benson Ogden, 48, was formerly from Oklahoma.

Police said the officer responded to a call about a man who was exposing himself. During the confrontation, they said the officer was sprayed with a "chemical agent." Maui's police chief said the agent was similar to pepper spray, but much stronger.

The victim was pronounced dead at Maui Memorial Medical Center. The officer was also taken to the hospital, where he was treated and released.

A Kihei woman who witnessed the incident said seven shots were fired.

Police ordered an autopsy for the man.

The officer is a 32-year old man who's been on the force for about 10-years. As part of procedure, he is now on administrative leave with pay.

In late January, Maui police shot and killed a 27-year-old woman who was driving a stolen car in Paia, after police said she tried to run them over. Toxicology tests showed the woman had crystal methamphetamine in her system.
