A Big Island man filed a lawsuit on Monday in connection with a crash that killed his baby daughter and critically injured his wife.

Aliyah Braden, 17 months old, was killed and her mother, Mayvelyn Braden, critically injured when police said a truck ran a red light in Kona.

Wayne Braden, the husband and father of the victims is now suing Valereen Kaleohano-Knittle and her husband Mark Knittle, accusing them of intoxication and negligence.

Wayne Braden said it is time to stop people from driving while drunk.

"It's not something we have to legislate. It's something we will legislate, but it's not something that we need to force down anybody's throats. We're one people one community all of us say to each other no more, it's over," Wayne Braden said.

Braden's wife is now in fair condition and has moved to a rehabilitation hospital.

Services for their daughter will be held in July on the Big Island.
