A man who was drunk and speeding when he ran over a pedestrian was sentenced to 10 years in prison on Monday morning.

Paene Magarro, 70, died while jay walking to a bus stop near Castle junction.

Thomas Copeland, 38, was found to have a 0.097 blood-alcohol level and was going over 55 mph when he saw the victim and hit the breaks.

Copeland accepted responsibility and apologized immediately, but prosecutor Darrell Wong argued that Copeland had a prior DUI conviction, poor driving record and numerous TRO violations that showed poor respect for authority and an inability to overcome drug and alcohol addiction.

"He's a danger to the community, he's a danger to himself, obviously," deputy prosecutor Darrell Wong said.

"I see this accident over and over in my mind. This has been a terrible tragedy above all for the family, but for myself as well. A part of me died on that roadway that morning your honor," Copeland said.

Judge Virginia Crandall agreed that serious punishment was needed and sentenced Copeland to the maximum 10-year sentence for negligent homicide. The parole board will determine the actual time he spends in prison.
