Wife Testifies In Man's Rape, Murder Trial

Woman Says Defendant Was Home Night Of Slaying

The wife of an accused killer and rapist took the stand in his trial on Tuesday.

Nancy Delacruz Griffin said her husband Darnell Griffin was home the night of Sept. 5, 1999, the night Evelyn Luka was raped and fatally beaten.

The pants Luka was wearing when she was found may not have been hers. She was petite, perhaps a size 2 or 3, while the pants found on Luka were size 10.

Griffin's wife was pregnant at the time.

"I was probably a double-digit size, probably a 10 to a 12," Nancy Delacruz Griffin said

Nancy Delacruz Griffin said she knows where her husband was that night.

Prosecutors said Griffin was tied to the long-unsolved murder by a DNA match.

Griffin's attorney said Griffin had consensual sex with the victim the night before she was attacked.

A break in the case did not come until 2007, when a national criminal database came up with a DNA match.

Griffin's DNA was in the database because felons are require to submit a sample. He was convicted of murder in 1983 in the death of a woman who was strangled.
