Court Backs Ban Of Superferry Protestors In Water
Ruling Keeps Protestors Out Of Nawiliwili Harbor

HONOLULU -- A federal appeals court has endorsed the Coast Guard's decision to bar Hawaii Superferry protestors from Kauai's Nawiliwili Harbor.After protestors on the water managed to blockade the harbor and block the Superferry from entering, the Coast Guard set up a security zone so large protestors would not be able to get in front of the ship.Opponents of the ferry sued, saying the security zone violated their rights to freedom of speech and that it violated environmental laws.The 9th Circuit Court of Appeals rejected their case, saying going into the water to block the ship was not protected speech and that the Coast Guard correctly followed the applicable environmental laws.Opponents said they are considering an appeal to the U.S. Supreme Court. The Superferry has not returned to Kauai since the protests.
